Drunk driving question. Arrested in Alabama with a Florida Drivers License.?

No prior arrests or convictions on any charges.

No bodily or property damage.

Refused breath test.



I am living in Alabama but still have a Florida License. I can establish residency through tax returns and plan to stay in Alabama.



Alabama Lic. suspension is 90 days.

Florida Lic. suspension is 1 year.

Which law will apply to me?



Can I apply for an Alabama Lic. after the suspension of 90 days or will I have to wait out the 1 year Florida suspension?

Both DMV's will communicate about the suspension. They are part of the interstate compact. What happens in one of the compact states will be communicated to the other state and the same thing will happen there. Sorry. You can't try to play around on this one. Your FL license will be suspended for one year, as well as any driving privileges in AL. Even if you can get the AL license before the suspension kicks in, FL will report it to AL once you have the license.

By law when you change residence you have so many days to change license. I would say you are screwed but ask the DMV.
